Conditions of participation, granting of usage rights and data protection information for the ‘Jever Best of Fans’ campaign


CAMPAIGN ORGANISER

The campaign organiser is Radeberger Gruppe KG, Darmstädter Landstr. 185, 60598 Frankfurt am Main, Germany.


PERSONS ENTITLED TO PARTICIPATE

Any natural person aged 18 or over is entitled to participate, with the exception of employees of the organiser, affiliated companies and cooperative partners and their relatives.


PARTICIPATION

Participation involves the uploading of a photo taken by the participant. The photos must fulfil the following criteria:

- Third parties must not be depicted in any way that makes them recognisable.
- Minors must not be depicted.
- No competitor products or third-party brands may be depicted.

Please also refrain from submitting photos that have obviously been edited (in which parts have been added or removed). Also, uploading photos with illegal, discriminatory, abusive or otherwise inappropriate content is not permitted.
The photos will only be approved after a brief inspection by the organiser. The organiser reserves the right not to approve, or to delete, individual photos without giving reasons.
The personal details required for participation (first name, surname, address) must be complete and correct.


PUBLICATION OF PHOTOS

All uploaded and approved photos will be publicly visible indefinitely in the ‘Best of Fans’ section of the website www.jever-beer.com.


CONFIRMATION BY THE PARTICIPANT

By uploading their entry, the participant confirms that they own all rights to the photo or that they have been authorised to upload it as part of the campaign. They also guarantee that the photo is free of third-party rights and, in case of the presence of other people therein, does not violate any personal laws. Furthermore, they also confirm that any other person visible in the photo agrees to its use/publication by the organiser as part of the campaign.


GRANTING OF USAGE RIGHTS

The participant grants the organiser the exclusive right to use the photo in edited and unedited form, with or without mention of their name, in all media (online (website, social media, etc.) in advertising, etc.) in connection with the campaign and transfers all corresponding rights of use to the organiser, with no restrictions in terms of time and place. The rights are granted free of charge and include the right of transfer to third parties which are contracted by or affiliated with the organiser.


PRIZE

Each calendar quarter, one Jever fan package containing various items from our Jever shop with a value of approx. 100 euros (no cash payment or substitute prize is possible).


DETERMINATION AND INFORMING OF THE WINNERS / CLAIMING THE PRIZE

At the end of each calendar quarter, a winner is chosen at random and notified via email soon after. The prize is sent by post after consultation with the winner.


EARLY TERMINATION, EXCLUSION

- The organiser reserves the right to cancel or terminate the competition at any time without prior notice or reason. This applies in particular if proper implementation cannot be guaranteed for technical or legal reasons. In such a case, participants are not entitled to make any claims against the organiser.
- The organiser reserves the right to exclude participants from the competition, for example in case of violation of the conditions of participation.
- The organiser reserves the right to change the conditions of participation or extend or limit the time frame or modify the content of the prizes, provided that there are objective reasons and the change is reasonable. The organiser will announce any new conditions on www.jever-beer.com.


LIABILITY

As far as is legally permissible, all liability on the part of the organiser is excluded.


MISCELLANEOUS

- Should individual provisions of these conditions of participation be invalid, the validity of the remaining provisions remains unaffected.
- German law applies.
- By entering, the participant agrees to these terms and conditions.


DATA PROTECTION

Personal data pertaining to participants will be processed for the execution of the competition and for the purpose of recording its correct implementation, and may also be transferred to service providers. Storage of participants’ personal data will generally be for six months after the entry date . For evidential purposes, winners’ data will be stored for ten years. As usage rights are transferred to the organiser as part of the campaign, data may also be stored as evidence thereof for the duration of the granting of rights. The legal basis for data processing is Article 6 (1) (b), (c) and (f) GDPR.

The participant has the right to information, correction, deletion, processing limitation, data portability and opposition (Art. 15–21 GDPR), and if necessary to the revocation of previously given consent (Art. 7 GDPR) and to complain to a supervisory authority (Art. 77 GDPR).
